Court Upholds Vaginal Mesh Settlement Against Ethicon Inc.

A New Jersey appellate court upheld an $11.1M vaginal mesh settlement against Johnson & Johnson (J&J) subsidiary Ethicon Inc. The jury in the original case sided with plaintiff Linda Gross, who alleged that the company was aware of the potential dangers of its Gynecare pelvic mesh implants and failed to warn patients of the risks in their marketing materials.

Gross sustained serious injuries from the mesh implant, resulting in 20 surgeries attempting to repair the damage. Judges agreed with her allegations, saying there was sufficient evidence to fault Ethicon’s lack of warning for Gross’ injuries. The appellate court found no reason to overturn the vaginal mesh settlement of $3.35M in compensatory damages and $7.76M in punitive damages to Gross.

Gross’ lawsuit is one of more than 67,500 claims filed against transvaginal mesh manufacturers. Suits against Gynecare include complaints that the implants can lead to soft tissue injury, tissue erosion, bleeding and infection.
