Should Bayer be Liable for Essure Complications?

Essure, a permanent birth control device, has recently been a topic of controversy and the center of a study by Weill Cornell Medicine in New York. The study found that women who had the device inserted for birth control had 10 times as many surgeries to fix problems created by Essure than did women who had their fallopian tubes tied instead. Essure consists of a pair of metal coils that are inserted into the fallopian tubes, where they create scar tissue to block sperm and prevent pregnancy.

Manufactured by Bayer, Essure was introduced to the market in 2002 and pitched as non-surgical alternative to permanent birth control. However, thousands of women have since come forward with issues ranging from severe abdominal pain and allergic reactions to the metal, to irregular bleeding and even punctured uteruses.

In September 2015, the FDA held a panel of experts to discuss the safety and effectiveness of Essure. The FDA is expected to complete the review this month and make a decision regarding the device. Because Essure received pre-market approval, it is currently protected from liability, meaning women experiencing these side effects are unable to sue the manufacturer.
