In the state of California, a recent Court of Appeals ruling has significant implications for Amazon and its massive customer base. According to the Court of Appeals, Amazon can now be held strictly liable for dangerous, defective products being sold either by third-party vendors or as part of the “Fulfilled by Amazon” program.

The battery was being sold by “E-Life”, a fabricated name being used by Lenoge Technology Ltd. Angela received her replacement battery inside of Amazon-branded packaging material. Within months, the replacement battery exploded. Although E-Life had been banned by Amazon, Angela was never informed of these developments after purchasing one of their products.
Although Amazon is seeking to appeal this decision, the impact of this current ruling will likely resonate throughout the broader e-commerce community. Safety should always be priority no. 1, and it will be interesting to observe how this decision changes e-commerce operations in both the short and long term.
