Who is at Fault for Fatal Motorcycle Accident?

A Twentynine Palms man was the victim of a fatal motorcycle accident Thursday evening. Authorities have identified 43-year-old Nikos Lukaris as the victim of the crash. The deadly accident occurred just after 6 p.m. on Amboy Road east of Sampson Lane.

According to the California Highway Patrol (CHP), the driver of a Ford F-350 pickup was heading east on Amboy Road when he moved into the westbound lane to pass another vehicle. That’s when the truck collided with the westbound motorcycle.

Lukaris died at the scene. He was apparently not wearing a helmet or other protective gear. Reports also say the motorcycle lacked proper lights and Lukaris was wearing dark-colored clothing. The pickup driver, 47-year-old Patrick Candelaria, suffered minor injuries. He was treated at the scene. His two passengers were not injured.

The CHP is still investigating the fatal motorcycle accident. The motorcyclist should certainly have been wearing protective gear. He should also have equipped his motorcycle with appropriate lights for riding in the dark. However, motorists are also responsible for driving safely around motorcyclists. This includes not passing other vehicles unless you are completely sure it is safe to do so. This is especially true when you are driving on a two-lane road, which was the case in this accident.
