Jury Awards Woman $15 Million in Pelvic Mesh Lawsuit

A New Jersey woman was awarded $15 million in damages in a pelvic mesh lawsuit against Johnson & Johnson. The plaintiff, 71-year-old Elizabeth Hrymoc, has suffered from chronic pain since receiving the defective mesh implant in 2008.

The device, called the Prolift, was created by Johnson & Johnson subsidiary Ethicon and introduced to the market in 2005. It was developed as an alternative treatment to pelvic floor reconstruction surgery for organ prolapse. The FDA approved the Prolift in 2002, but now considers it to be a high-risk treatment after receiving thousands of complaints.

Did Ethicon Researchers Ignore Risks?

Hrymoc argued that she was never informed of the risks associated with the mesh device. Additionally, her attorney showed evidence that Ethicon researchers had concerns about the mesh contracting and eroding once inside the vaginal wall. Despite concerns, the plaintiff argued, researchers continued developing the device and brought it to market without a clinical study.

Jury Unanimously Sides with Plaintiff in Pelvic Mesh Lawsuit

After six hours of deliberation, the jury reached a unanimous verdict that the pelvic mesh device was defective. The jury also agreed that Hrymoc had not been adequately warned of the risks.
