Man Awarded $2 Million in Defective Hip Implant Lawsuit

A hip implant patient who suffered metal poisoning from a defective hip implant device was awarded $2 million in a lawsuit last month. A New Mexico judge ruled that Zimmer Inc. must pay the plaintiff, Michael McDonald, $2 million for his injuries.

Defective Hip Implant Device Gives Patient Metal Poisoning

McDonald underwent hip implant surgery in 2010. The device used was Zimmer’s M/L Taper Hip Prosthesis with Kinectiv Technology (MLTK) and cobalt-chromium head. McDonald’s lawsuit states that he developed metallosis from the defective device. This form of metal poisoning occurs when metal-on-metal hip implant components rub together. Microscopic metal particles are released into the body.

According to the judge, McDonald’s poisoning was due to a defect in the hip implant. The verdict states that Zimmer failed to adequately test its design.

McDonald had to undergo a revision surgery in 2011. He will likely need a third surgery in the future to remove the implant and kill the infection. He would then need another hip prosthesis, requiring another recovery period.
