6 Victims Awarded $245 Million in DePuy Hip Implant Lawsuit

A federal judge in Texas has awarded six plaintiffs $245 million in a DePuy hip implant lawsuit. The final judgment was entered on August 29, nine months after a jury awarded the plaintiffs $247 million. The smaller amount was agreed to after private insurance agreed to cover $1.2 million of the plaintiffs’ medical expenses.

The six plaintiffs sued DePuy Orthopaedics and its parent company Johnson & Johnson for injuries they sustained as a result of receiving DePuy Pinnacle hip replacements. The lawsuit claims the companies knew the hip implants were defective, yet failed to issue a major recall. Instead, they phased out the metal-on-metal devices that had harmed so many patients.

The verdict includes $90 million in punitive damages. The judgment amounts for the six plaintiffs were divided up based on the extent of their individual injuries.
