A North Carolina woman has filed a lawsuit against Takata over vision loss she suffered from an exploding airbag. Plaintiff Kelijah Hall was involved in an accident in Charlotte, North Carolina, in 2015 while driving a Nissan Sentra. The vehicle’s airbag exploded, shooting shrapnel into her eye.
According to the lawsuit, Hall developed an eye infection from the injury, which resulted in several eye operations. Now, three years later, Hall says she has lost vision in the injured eye, and still has to undergo treatment. She says she has also suffered permanent cosmetic problems from the injury. The lawsuit seeks $75,000 in compensatory damages, along with punitive damages. Both Takata and Nissan are named in the lawsuit.
Millions Set Aside for Takata Settlements
Earlier this year, 13 automakers agreed to contribute up to $130 million to compensate those who were injured by Takata airbag inflators, as part of a settlement to resolve Takata’s bankruptcy. The deal allowed Takata to sell its non-inflator business to Key Safety Systems—a vital move to ensure car parts would continue to be made for the biggest automakers.
Then this summer, Ford agreed to spend up to $299 million to settle lawsuits filed by roughly 6 million vehicle owners over Takata airbags. The settlement covers vehicle owners who claim their vehicles decreased in value due to the Takata airbag inflators.
According to the National Highway Traffic Safety Administration (NHTSA), 15 people in the U.S. have been killed by the exploding airbag inflators, and at least 250 people have been injured.
“Takata airbag inflators have caused irreparable harm to hundreds of people. Those who have been injured should be fairly compensated for their losses,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
