What Happens When Your Car Accident Case Goes to Trial?

Usually a car accident case is settled before a trial takes place. However, in some cases, going to court is necessary. One reason your case might go to trial is if you and the other party cannot agree to a settlement amount. Or perhaps the insurance company does not agree that their client caused the accident and is refusing to settle at all.

Here is what to expect if you car accident lawsuit goes to trial:

  1. The jury will be selected. Potential jurors will be asked a series of questions to ensure they are impartial to the outcome of the trial.
  2. The attorneys will make opening statements. This is an opportunity for both attorneys to introduce the jury to their side, and to explain what the evidence they will be presenting will show about the case.
  3. The plaintiff presents evidence. During this part of the trial, you attorney will present the evidence against the defendant. This is when any witnesses will be called to testify. These might include bystanders who saw the accident or the doctor who treated you for your injuries.
  4. Once your attorney has presented all their evidence, the defense then has an opportunity to present evidence.
  5. After each side has presented their evidence, the attorneys for each side will give closing statements. Your attorney will remind the jury of the evidence that was presented, and explain how that evidence should lead them to a verdict in your favor.
  6. The jury will then deliberate on the evidence to reach a verdict. The deliberations are confidential, and they can last anywhere from a few hours to several days.
  7. When the jury reaches a verdict, they notify the judge that they have done so. The judge then brings the jury back to the courtroom and the verdict is read to all the parties.

There is no set rule for how long a car accident trial can take. However, these trials usually last only a few days, from the time the jury is selected to when the verdict is reached.
