A new lawsuit against C.R. Bard claims the company’s Ventralex hernia mesh device was defective and caused the plaintiff to suffer serious complications. The plaintiff, a man from Iowa, says he has suffered chronic complications and diminished quality of life since he had the device implanted for an incisional hernia repair.
The plaintiff had the device implanted in June 2015. Just two months later, he had to undergo revision surgery for hernia recurrence. His surgeons found that the Ventralex ST Mesh had retracted into the hernia and could not be removed because it had gotten too deep into the hernia. It was not until June 2017 that the mesh was successfully removed.
According to the lawsuit, the polypropylene coating of the mesh can cause inflammation, which can then lead to infection. Moreover, it can also necessitate revision surgery, which is considered riskier than the implant surgery. The plaintiff’s lawsuit alleges that Bard knew about these risks of complications, yet failed to warn patients.
“Patients have a right to know all the possible side effects of a medical device before undergoing a surgical procedure,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
