Seeking Justice After Local Tractor-Trailer Crash
In a local case a few years ago, a driver was killed after his vehicle collided with a tractor-trailer. The CHP interviewed the driver and co-driver of the 18-wheeler and concluded that the driver of the car was at fault. The conclusion was that the car had been speeding. Additionally, they said the driver violated California Vehicle Code Section 21800, which says the driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection.
What Really Happened?
The accident happened in the early morning hours in a remote area when it was very dark. When the truck pulled out from a stop sign, the car went under the truck. The roof of the car was sheared off and the driver was killed.
WCLG attorney Jessica Albert worked with experts to do a thorough reconstruction of the tractor-trailer crash. The evidence clearly revealed the car driver was not at fault. Analysis of the car’s Event Data Recorder (black box) revealed that the car had not been speeding. In fact, the driver had applied his brakes.
Additionally, the markings under the tractor’s trailer clearly revealed that the 18-wheeler was moving at a speed that indicated it had not stopped at the stop sign. In fact, the truck had pulled out right in front of the unsuspecting driver.
After nearly 3 years of litigation, $3.8 million was paid to the widow for the loss of her husband.
