A Tennessee woman has filed a lawsuit against C.R. Bard, claiming the company’s hernia mesh caused her to suffer serious injuries. The Bard Dulex Mesh is used to repair a ventral hernia—a hernia that forms within the muscles of the abdominal wall.
According to the plaintiff, she was implanted with the mesh in 2008 to repair a hernia, and was not informed of possible complications. Then in 2012, she underwent surgery to remove the mesh, which had become infected. The plaintiff then underwent additional surgeries to treat complications related to the mesh implant, and continues to suffer pain as a result.
Was Hernia Mesh Negligently Designed?
According to the lawsuit, the material of the hernia mesh can cause adverse tissue reactions. The plaintiff claims that the mesh was negligently designed, and that it allows bacteria to enter the body and hide from the body’s natural defenses. She also claims that the mesh releases toxic chemicals that cause inflammation and scar tissue in the body. The malfunctions, the lawsuit claims, can lead to nerve entrapment, nerve damage, erosion of the mesh into organs, and chronic pain.
Additionally, the lawsuit claims that Bard and its subsidiary Davol knew about the problems with Dulex Mesh, yet failed to warn doctors and patients of the risks.
