Big News About Amazon

In the state of California, a recent Court of Appeals ruling has significant implications for Amazon and its massive customer base. According to the Court of Appeals, Amazon can now be held strictly liable for dangerous, defective products being sold either by third-party vendors or as part of the “Fulfilled by Amazon” program.

For consumers, this information should come as a welcome surprise. Anyone following the news has most likely seen reports where defective, potentially harmful products are being sold to consumers. In some situations, the companies or vendors selling these products to online buyers are operating under names that are made-up or not legally sound. Prior to this ruling, customers who were injured or otherwise harmed by these products would have little to no legal recourse when it came to holding Amazon accountable. Now, options exist for consumers to ensure that their voices are heard.

The case which led to this ruling involved Angela Bolger, a woman who suffered severe burns after buying a laptop battery on Amazon to replace her current battery. The battery was being sold by “E-Life”, a fabricated name being used by Lenoge Technology Ltd. Angela received her replacement battery inside of Amazon-branded packaging material. Within months, the replacement battery exploded. Although E-Life had been banned by Amazon, Angela was never informed of these developments after purchasing one of their products.

Although Amazon is seeking to appeal this decision, the impact of this current ruling will likely resonate throughout the broader e-commerce community. Safety should always be priority no. 1, and it will be interesting to observe how this decision changes e-commerce operations in both the short and long term.
