Pharmaceutical company AbbVie has been ordered to pay $3 million to a man who suffered a heart attack after taking AndroGel, the company’s testosterone replacement drug.
Oregon resident Jesse Mitchell had a heart attack in 2012, nearly five years after he began taking AndroGel. In July 2017, a federal jury in Chicago found AbbVie fraudulently misrepresented the risk of AndroGel. The jury ordered AbbVie to pay Mitchell $150 million in punitive damages. However, a U.S. district judge later tossed the verdict, stating it was “logically incompatible.”
In the retrial, the jury concluded that, while AbbVie had not falsely marketed the drug and was not strictly liable, the company still acted negligently. The jury awarded Mitchell $200,000 in compensatory damages and $3 million in punitive damages.
