Jury Hands Down $383 Million Verdict in DaVita Wrongful Death Suit

A Denver jury has ordered DaVita Inc. to pay $383.5 million to the families of three patients who died after receiving dialysis at the company’s clinics. The wrongful death lawsuits against the dialysis company claimed that the patients suffered cardiac arrest after being treated with GranuFlo, a solution that replaces lost fluids and minerals in patients while they are receiving dialysis.

According to the lawsuits, DaVita should have known GranuFlo could cause complications in certain patients. The attorney representing the plaintiffs stated that DaVita ignored many red flags prior to the patients’ deaths.

The three families were each awarded $1.5 million to $5 million in compensatory damages, and $125 million in punitive damages. DaVita says it will appeal the decision.

“We are glad the jury has sided with the families of the victims in this wrongful death case,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
