Proposition 103 provided for the State Insurance Commissioner to regulate California insurance rates. According to Consumer Watchdog, “For ten years, Mercury enabled and promoted a system to avoid Proposition 103’s prohibition against illegal agent fees and bilked consumers out of millions of dollars.”

In 2015, state regulators levied a $27.5 million fine against Mercury Insurance Group for charging customers fees that were not approved by the Department of Insurance.

It has also been noted that Mercury is the only insurance company that sponsored a law allowing them to charge soldiers more.
