Last week, a judge ordered drugmaker AbbVie to pay more than $140 million to a plaintiff who had a heart attack while using the drug AndroGel. Plaintiff Jeffrey Konrad suffered a heart attack months after he started taking AndroGel, a testosterone medication.

The lawsuit claimed Abbie failed to warn doctors and patients of the risk of heart attacks and other side effects. The company is also accused of aggressively marketing the drug to men without addressing the serious complications that can arise. Additionally, AndroGel is approved to treat the condition hypogonadism, but AbbVie allegedly promoted the medication for broader use.

Verdict is AbbVie’s 2nd Loss This Year

The Chicago jury that heard the case awarded the plaintiff compensatory damages of $140,000 and punitive damages of $140 million. AbbVie intends to appeal the verdict. This is the second major loss for the drugmaker this year. In July, AbbVie lost a $150 million lawsuit. The plaintiff, Jesse Mitchell, had also suffered a heart attack after using AndroGel.

“Unfortunately, this is one of many cases where a drug company prioritized profits above the health of its customers,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
