Court Overturns DePuy Hip Replacement Verdict

An appeals court reversed a $151 million verdict against Johnson & Johnson and its subsidiary DePuy Orthopaedics, over claims of tainted evidence and deceptive trial tactics. The 5th Circuit Court ordered a new trial for the case.

The lawsuit, Christopher v. DePuy Orthopaedics, was a bellwether trial for thousands of plaintiffs in a multi-district litigation. The jury in the original case awarded the plaintiff $502 million, but the award was reduced to $151 million due to the Texas damages cap.

According to the 5th Circuit, the plaintiff’s attorney Mark Lanier violated the Rules of Civil Procedure during the trial. Among other issues cited by the court was the fact that Lanier told the jury his experts were “not retained,” but then paid them after the trial. It is unclear when the new trial will take place.
