Do E-Cigarette Liquids Look Too Much Like Children’s Snacks?

The Food and Drug Administration (FDA) and Federal Trade Commission (FTC) joined forces last week to send a message to the e-cigarette companies. That message? Stop packaging and advertising tobacco and nicotine products in ways that appeal to young children.

The FDA began investigating tobacco product labeling last year. In its warning letter to the companies this month, regulators state that the e-cigarette liquids described in the letter are considered “misbranded.” These companies are in violation of the Federal Food, Drug, and Cosmetic Act, as their labels mimic children’s food and drink products. Additionally, the FTC says the products are in violation of Section 5 of the FTC Act, which prohibits unfair and deceptive marketing.

Many of the e-cigarette liquids in question are packaged to resemble kid-friendly products, such as juice boxes, candy and cookies. They even have a similar scent to these products. For instance, there is an e-liquid called “One Mad Hit Juice Box,” which is packaged to look like a child-friend juice box.

E-Liquids Can Be Deadly for Small Children

This is an issue not only because it makes these products appealing to children, who should not be using tobacco products, but also because consumption of these liquids can be detrimental to children. According to an analysis of the National Poison Data System, there were 8,269 e-cigarette and liquid nicotine exposures among children younger than age 6, from January 2012 through April 2017. Children have a greater risk of harm from consuming e-liquids, as even a small amount can result in acute toxicity. In the worst cases, this can result in death.
