Should Vape Companies Be Held Responsible for E-Cigarette Explosions?

Another e-cigarette explosion has turned into a lawsuit. James Dardini of DeLand, Florida, is suing Sunshine Vapor, a vape shop in Deltona, as well as e-cigarette manufacturer, Kangertech, and e-cigarette wholesale distributor, Perfect Vape.

Dardini claims his leg caught fire when his e-cigarette exploded in his vehicle last December during his hour-long commute to work. He had to be admitted to the emergency room burn unit and undergo surgery for his injuries.

The e-cigarette companies named in the suit have filed a motion to dismiss the case. The companies claim that buyers are warned against using their products while driving long distances or in extreme temperatures. However, Dardini’s attorney alleges the e-cigarettes contain cheap batteries that are not well-ventilated, which allows heat to build up and leads to the explosions.

This lawsuit is just one of many e-cigarette suits pending in various states including California, New York and Texas. The FDA decided earlier this year that e-cigarettes would be subject to federal regulation like other tobacco products. The regulations will include oversight of the batteries used in e-cigarettes, which are cited in most of the lawsuits as the reason for the explosions.
