Witness statements can be an important aspect of a personal injury case. If someone saw your accident, you will want to include their witness statement as part of the evidence against the at-fault party.

If there were any witnesses to the crash, do your best to speak with them at the scene. Ask the witness to write down what he saw happen to the best of his memory. Make sure you get the witness to sign and date his statement, and provide his contact information.

If no witnesses stopped at the scene, you might need to take a look at the surrounding area to see if anyone might have seen the accident. If there are homes or businesses in sight of the scene, it doesn’t hurt to ask if anyone nearby saw it happen. Making the effort to seek out potential witnesses could end up greatly affecting your case.

Remember when speaking with witnesses to be as polite and calm as possible. Don’t use inflammatory language to try to sway them, as it can give off the wrong impression. You might very well be angry at the at-fault driver and the situation, but don’t say any of that to the witness.
