States Sue Generic Drugmakers for Price-Fixing

Forty-five states and the District of Columbia are involved in a lawsuit against generic drugmakers for price-fixing. The defendants include 18 generic drug manufacturers, including Mylan Pharmaceuticals, the maker of EpiPen.

According to the lawsuit, the companies divided customers among themselves, so that each would have a certain percentage of the market. The states also allege that the companies even agreed on price increases in advance.

The lawsuit also specifically names two executives: Rajiv Malik, president of Mylan NV, and Satish Mehta, CEO of India’s Emcure Pharmaceuticals. The states claim that the two agreed to their companies’ shares of the market for a common antibiotic, doxycycline hyclate.

Lawsuit Expanded to Include More Drugmakers

This lawsuit is an expansion of an initial lawsuit that targeted only two medicines, doxycycline and glyburide. Doxycycline increased in price from $20 to $1,849 for 500 tablets between October 2013 and May 2014. The amended complaint includes diabetes drugs glipizide-metformin and glyburide-metformin, along with acetazolamide for glaucoma and epilepsy treatment and several others.

Meanwhile, the U.S. Justice Department is conducting a criminal investigation.
