Good news for passenger’s rights: Though the cruise industry wrote contracts to insulate themselves from justice, two recent decisions are chipping away at that block to fairness. Although the cruise ships are typically insured for losses resulting from their negligence, the fine print in the cruise tickets severely limits passenger’s rights. For instance, most passengers are unaware that the ticket reduces the four-year statute of limitations to only one year.
In the case of Franza v. Royal Carribean Cruises, a U.S. Court of Appeals held that passengers injured or killed as a result of ship board medical negligence have a right to go to court. A previous decision had barred passengers from seeking redress for more than 25 years. In 2015, the same court expanded passengers’ rights in the Sorrels case, holding that right to trial by jury remains in maritime cases.
