A Tragedy at Zelda’s Sparks Response From Walter Clark Legal Group

A recent shooting at Zelda’s nightclub in Palm Springs left Noah Davison, 21, dead and his 2-year old son without a father. Now, Cynthia Cabrera, Davison’s former partner and the mother of his child is working alongside the team at Walter Clark Legal Group to hold the city of Palm Springs accountable for this tragedy.

In 2012, the city of Palm Springs implemented a new security plan for Zelda’s which involved the installation of multiple security cameras. The objective was relatively simple: create a system of 24/7 surveillance which would not only document criminal activity occurring in the parking lot of the club but also act as a deterrent for future crime.

Over the next seven years, over 100 reports of criminal activity were documented here. To this day, the cameras mandated by the city have never been installed.

Bringing Legal Action to Palm Springs

Cabrera has filed suit against the city of Palm Springs, naming her son as the intended claimant. According to David Vassalli, an attorney at the Walker Clark Legal Group working with Cabrera, the blame for this situation rests not only on the criminals who perpetrated the crime but also the city of Palm Springs. In the words of Vassalli, “The city of Palm Springs’ failure to address the dangerous condition, of which they were well aware of for 7 years, needlessly put the public at risk and ultimately led to the death of the claimant’s father”.

As for Zelda’s, swift action has been taken. The club’s business permit was suspended in January as part of a series of punitive actions which also required the club to work alongside the Palm Springs Police Department to develop a new security protocol. Only a week later, Zelda’s shut down for good.

Although Zelda’s may never host another criminal act in its parking lot, the damage has already been done for Davison, Cabrera and her son. It is the hope of Walter Clark Legal Group that their suit sends a strong message to the city. No child should ever have a parent taken from them in this manner again.
