Woman Awarded $20 Million in Vaginal Mesh Lawsuit

A Philadelphia jury sided with the plaintiff in a Johnson & Johnson vaginal mesh lawsuit Friday. Peggy Engleman of Cinnaminson, New Jersey, was awarded $20 million after a three-week trial in Common Pleas Court.

Engleman had a TVT-Secur vaginal mesh device implanted in 2007 for stress urinary incontinence. Within a month, Engleman’s issue returned and she began experiencing pain. Doctors determined the device had begun eroding inside her body. Engleman underwent three surgeries, but doctors were unable to remove all the polypropylene mesh. As a result, the 56-year-old now suffers from permanent urinary dysfunction, chronic vaginal pain and pelvic floor spasms.

Engleman’s attorneys argued that the vaginal mesh device was defective. They also claimed J&J and its subsidiary Ethicon were aware of the risks, yet failed to warn doctors and patients and continued to market the device.

J&J Continues to Pay up in Vaginal Mesh Lawsuits

The verdict is the third win in a row for a vaginal mesh lawsuit against J&J in which a device eroded inside a patient. Last year, a New Jersey court awarded a woman $13.5 million in a similar case. In 2015, a victim in Indiana was awarded $12.5 million after she was seriously injured by a vaginal mesh device.

“Patients should have been warned of these severe side effects before being fitted with these devices. We’re glad the jury has prioritized consumer rights in this case,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
