A Minnesota woman has filed a lawsuit against Zimmer, Inc., alleging the company’s Kinectiv hip implant device caused her to suffer serious injuries. She is suing the company for defective manufacturing and design of the product, as well as failure to warn, negligent misrepresentation, and breach of warranties.
In 2008, the plaintiff underwent a total hip replacement, in which she was implanted with the Zimmer Kinectiv hip system. The surgery was initially successful, but the plaintiff later developed metallosis—a condition that can occur when metal debris builds up in a person’s soft tissue. It is caused by metal components rubbing against one another and releasing metal into the bloodstream. Metallosis can cause tissue damage and other issues, such as nervous system damage.
The plaintiff says she suffered serious pain as a result of the damage, and is likely to experience long-term effects of the metallosis. She had hip revision surgery in 2015, in which her surgeon discovered tissue death in the area of the device. According to the lawsuit, Zimmer was aware of the issues with the device, but failed to sufficiently test the product prior to marketing it.
“Companies have long been aware of the dangers of metal-on-metal implant devices, yet many have failed to adequately warn patients, or to remove dangerous devices from the market,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
