The owner of a drug compounding company who was convicted of racketeering and fraud in regard to a deadly meningitis outbreak in 2012 has been ordered to forfeit $7.5 million. Barry Cadden is the former president and part owner of the New England Compounding Center (NECC). The drug company distributed contaminated drugs that led to the meningitis outbreak. The government says it will give the forfeited money to the victims of the outbreak.
However, this forfeiture order is separate from any restitution order Cadden might be forced to pay to the victims. This is important, as federal prosecutors have also filed a motion to have Cadden pay $73.7 million in restitution to 349 victims.
Cadden Serving 9-Year-Sentence
Cadden is currently serving a nine-year sentence for racketeering, fraud and conspiracy. According to the prosecutors of his case, Cadden ran NECC as a criminal enterprise that sold substandard, non-sterile drugs. The drugs were produced in unsanitary conditions, then shipped throughout the country. This led to a nationwide meningitis outbreak in 2012. In all, 778 patients were harmed by contaminated steroids from the drug compounding company, and 76 died from their injuries.
“This individual’s carelessness and greed resulted in death and injury to many people. There must be serious consequences for such reckless disregard for human life,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
