Does Indio Drunk Driver Deserve Murder Charges?

The drunk driver responsible for a fatal multi-vehicle crash in Indio the day after Christmas is being charged with homicide. Juan Gomez, 48, was initially arrested for driving under the influence after he crashed into several vehicles at Monroe Street and Avenue 48.

A 14-year-old who was injured in the crash died from his injuries after he was transferred to Loma Linda Children’s Hospital. The victim’s identity has not been released. Thirteen other people were injured in the multi-vehicle crash, four critically. The condition of the other victims has not been released.

Gomez is being held without bail at the Riverside County Jail in Indio. He is charged with homicide, gross vehicular homicide while intoxicated, felony driving while intoxicated causing injuries and driving under the influence. Vehicular homicide, a felony offense, is a more severe charge than vehicular manslaughter, which can be filed as either a misdemeanor or felony depending on the circumstances. DUI murder charges are usually filed when a prosecutor can prove the defendant knew the risk of driving drunk and made the conscious decision to do so anyway. Generally this happens when a suspect has a prior DUI conviction, but it can be issued under other circumstances. If convicted, the drunk driver can be sentenced to life in prison.
