Your Questions Answered: Health Insurance and Accident Bills

We’ve taken the the time to answer one of the most important questions we  are asked regarding health insurance payments and accident liability. Understanding how medical bills will be paid following an accident is a critical issue facing a large number of drivers today. Take a look below to learn more about how you can move forward with treatment following an accident.

Question:  Do I have to pay my health insurance back any money for bills if the accident was not my fault?

Answer:

The at-fault driver is responsible for paying your medical bills from a car accident, not your health insurance company.

Your health insurance pays your medical bills if you injure yourself or have a natural health condition requiring treatment.  However, when a third party causes your injury by being negligent, it is the insurance of the negligent driver who is responsible to pay your medical bills.  Your health insurance company will still pay your medical bills on the front end, and a lien will be asserted against your settlement with the negligent driver.  This “lien” is essentially a credit your health insurance company gets against the automobile insurance company of the negligent driver.

For many injured victims, this process leaves them feeling like they themselves are having to pay their health insurance company back for their medical bills.  In reality though, it is the insurance company of the negligent driver paying your health insurance company back for the bills your health insurance company paid on the front end.

At Walter Clark Legal Group, we fight for you by refusing to pay back your health insurance company all the money they are seeking to recuperate from your settlement with the negligent driver.  Negotiating with our client’s health insurance company to reduce the amount of money they get maximizes our client’s recovery, which is part of the “Client First” approach we take at Walter Clark Legal Group.
