Judge Upholds Talc Verdict Against Johnson & Johnson

A judge has upheld a $117 million verdict against Johnson & Johnson and its talc supplier Imerys Tal America Inc. The damages were awarded to New Jersey man Stephen Lanzo, who claimed to have developed mesothelioma due to decades of using Johnson’s Baby Powder. The suit was the first mesothelioma verdict involving J&J talc products.

Ovarian Cancer Talc Verdict Overturned

While this verdict has been upheld, another verdict against the company has been overturned in Missouri. In 2016, a jury awarded South Dakota resident Gloria Ristesund $55 million in a lawsuit against J&J. The suit claimed the company’s talc products used by the plaintiff for feminine hygiene caused her to develop ovarian cancer, resulting in a hysterectomy.

The appellate court found that the suit should not have been filed in Missouri, as the plaintiff was not a Missouri resident and the defendant was not headquartered there. The decision was based on a 2017 Supreme Court ruling that limits where lawsuits may be brought.
